Donation terms

These Donation Terms apply whenever you make a donation through the effort.giving platform. They sit alongside our Terms of Service and Privacy Policy. They are linked at checkout, and by proceeding with a donation you agree to them.
1. Who you are giving to
When you donate by card through this platform, your donation is made to EffortX Foundation Ltd(ACN 693 961 330, ABN 26 693 961 330), an Australian not-for-profit company limited by guarantee, the “Foundation”. Its application for registration as a charity with the ACNC is under assessment (see section 4 on tax). The Foundation receives your payment directly into its own accounts and is the legal recipient of your gift.
The platform technology is operated by EffortX Labs Pte. Ltd. (Singapore) as the Foundation’s service provider. Labs does not receive or hold your donation.
Different rule for QRIS / Indonesian bank transfer: where we display a partner charity’s own QRIS code or bank account details, payments made that way go directly to that partner, never to the Foundation. See section 8.
2. Your donation is a gift
Donations are voluntary gifts. They are not payments for goods or services, and you receive no material benefit in return. Once made, a donation belongs to the Foundation and is applied to its charitable purposes as described in these terms.
3. Project preferences and how funds are applied
When you donate to a specific project or charity, you are expressing a preference, which the Foundation honours wherever possible. Funds for partner-delivered projects are released to verified in-country partners in stages, only after the Foundation verifies evidence that each project milestone has been delivered.
If a project is overfunded, cancelled, or cannot proceed (for example, a partner ceases to qualify, or field conditions change), the Foundation applies your donation to another project serving a similar charitable purpose, delivered by a verified partner, and notifies you where practicable. This is how we ensure your gift always reaches charitable work even when a specific plan changes.
4. Tax deductibility, important
Donations to the Foundation are not currently tax-deductible in Australia.
The Foundation’s ACNC charity registration application is under assessment, and Deductible Gift Recipient (DGR) endorsement is being sought from the ATO. Unless and until both are granted, you will receive an acknowledgement of your gift, not a tax receipt. There is no guarantee registration or endorsement will be granted. If they are, we will say so clearly on the platform, and donations from that point will receive DGR receipts where eligible. Nothing on this platform is tax advice. Consult your own adviser.
5. Platform fee and payment costs
A 5% platform feeapplies to every donation. It is not optional, and there is no opt-out. The fee covers the cost of running the platform and is paid to the Foundation’s technology provider, EffortX Labs Pte. Ltd.
Your full donation is your gift to the Foundation. The Foundation applies the 5% from that gift to platform costs and directs the rest (around 95%) to the charitable work. Your receipt or acknowledgement states your full donation as the gift.
Card processing fees (around 3%) are added to your payment at checkout and shown to you before you confirm. They are not taken out of your gift: your full donation reaches the Foundation, and you pay the processing cost on top.
6. Refunds
We refund donations made in error, duplicates, wrong amounts, unauthorised use of your card, if you contact us at hello@effort.giving within 30 days. Refunds go back to the original payment method. Outside genuine error, donations are non-refundable once made, and we generally cannot refund amounts already disbursed to projects. If you change your mind within 14 days and the funds have not yet been allocated to a project, contact us and we will consider it in good faith. Initiating a card chargeback for a donation you authorised may result in recovery costs and suspension of your account.
7. Recurring donations
You can cancel a recurring donation at any time in your account settings or by emailing us. Cancellation takes effect from the next billing cycle. Already-processed instalments are treated under section 6.
8. QRIS and partner-direct payments (Indonesian donors)
Some partner charities display their own QRIS code or bank account on the platform. Payments made to those instruments go directly from you to the partner on the partner’s own payment rails. For those payments:
- the Foundation never receives, holds, or sees your money;
- the Foundation issues no receipt of any kind, and the gift is not tax-deductible in Australia;
- any receipt (kuitansi) is the partner’s responsibility under Indonesian rules. Contact details are shown alongside the payment instrument;
- refunds and disputes are between you and the partner.
9. No guaranteed outcomes
We verify partners and require evidence before releasing funds, but charitable work in difficult environments carries risk. We do not guarantee that any project achieves its intended outcomes. We commit to transparency: project progress, milestone evidence, and disbursements are published on the platform’s transparency pages.
10. Australian Consumer Law
Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Competition and Consumer Act 2010(Cth) or equivalent state laws that cannot lawfully be excluded. To the extent permitted by law, the Foundation’s liability for a breach of a non-excludable guarantee is limited to resupplying the relevant service.
11. Changes
We may update these Donation Terms. Material changes take effect for donations made after the change. We will ask you to accept the updated terms at your next donation. The version you accepted at checkout governs that donation.
12. Contact, complaints, and law
We acknowledge complaints within 7 days and respond within 30 (matching our Privacy Policy timeframes). These terms are governed by the laws of New South Wales, Australia.
